Terms of Service

1. Acceptance of Terms

By downloading, installing, accessing, or using the App, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the App. You represent that you are legally capable of entering into these Terms and, if you use the App on behalf of a company or other entity, that you have authority to bind that entity.

2. Licence Grant

Subject to these Terms, Ranjha Inc. (“we,” “our,” or “us”) grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use the App on Apple-branded products that you own or control, solely as permitted by these Terms and the Apple usage rules applicable through the App Store. The App is licensed, not sold, and all rights not expressly granted to you are reserved.

3. Apple App Store Terms

1. The App is distributed through Apple's App Store and your use of the App must comply with any applicable Apple terms, policies, and usage rules.
2. Apple is not responsible for providing maintenance or support services for the App.
3. To the maximum extent permitted by law, Apple is not responsible for any claims relating to the App, including product liability claims, claims that the App fails to conform to any legal or regulatory requirement, or claims arising under consumer protection, privacy, or similar laws.
4. In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Apple will not be responsible for the investigation, defense, settlement, or discharge of such claim.
5. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you.

4. Paid Features, Billing, and Renewal

1. The App is free to download and use with limited functionality. Free-user photos may include a visible watermark.
2. The App may offer an auto-renewing monthly flag7x Pro subscription for $4.99 per month.
3. An annual subscription option may also be available through your Apple subscription settings for $19.99 per year, even if it is not prominently advertised in the App.
4. The App may also offer a one-time lifetime purchase for $24.99. Unless otherwise required by law, “lifetime” refers to the lifetime of the purchased offering as made available by us, and does not guarantee perpetual updates, perpetual compatibility with future devices or operating systems, or that the App will remain available indefinitely.
5. All in-app purchases, subscriptions, billing, renewals, cancellations, refunds, and payment processing are handled by Apple through your Apple ID account, not by us directly.
6. Subscription charges are billed to your Apple ID account at confirmation of purchase and, for auto-renewing subscriptions, renew automatically unless cancelled at least 24 hours before the end of the current billing period.
7. Your Apple ID account may be charged for renewal within 24 hours before the end of the current subscription period. You can manage or cancel subscriptions through your Apple account settings.
8. Except where required by applicable law or Apple's policies, all purchases are final and non-refundable.
9. We may change pricing, product offerings, or feature availability prospectively, but changes will not affect a current subscription period that has already been paid for unless otherwise permitted by law or Apple's platform rules.

5. Watermarks, Captures, and App Functionality

1. Photos and videos captured while using the free version of the App may contain a watermark.
2. Upgrading to a paid version removes the watermark only for eligible future captures made after the upgrade, subject to the features then available in the App.
3. Photos or videos previously captured as a free user will remain as originally saved. Because we do not store your captured media on our servers, we cannot retrieve, edit, or remove watermarks from prior captures.
4. The App is intended to create images or video by capturing them within the App itself. The App is not a general photo-editing service and does not provide a right to upload previously captured media from outside the App and apply the same capture experience or effects retroactively.
5. We may modify, improve, suspend, or discontinue features, products, purchase options, or parts of the App at any time, subject to applicable law.

6. Intellectual Property

The App, including its software, source and object code, interface design, graphics, visual elements, text, documentation, trademarks, trade names, logos, branding, and all related intellectual property rights, is and remains owned by Ranjha Inc. or its licensors and is protected by applicable intellectual property and unfair competition laws. Except for the limited licence expressly granted in these Terms, you receive no ownership or other rights in the App.

7. No Affiliation With Canon

The App is an independent product and is not affiliated with, endorsed by, sponsored by, authorized by, or otherwise associated with Canon Inc., Canon U.S.A., Inc., or any of their affiliates, products, or services. Any references to camera styles, visual looks, or aesthetic inspiration are descriptive only and do not imply any partnership, approval, or origin. You acknowledge that your use of the App will not create confusion as to source, sponsorship, or endorsement.

8. User Content and Responsibility

You retain any copyright you may have in photos or videos you create with the App. However, you are solely responsible for your conduct and for all media, subjects, locations, metadata, and other content created, captured, stored, or shared using the App.

1. You represent and warrant that you have all rights, permissions, and consents necessary to capture, store, use, and share your content.
2. You are solely responsible for compliance with all laws, regulations, contracts, and platform policies applicable to your use of the App and your content, including laws relating to privacy, publicity rights, surveillance, biometric information, geolocation, minors, employment, and intellectual property.
3. We do not review, monitor, endorse, or assume responsibility for your content, and we disclaim liability arising out of or related to your content or your use of the App to create it.

9. Privacy, Connectivity, and Permissions

The App is designed to function substantially offline, but certain features and background services may use an internet connection, including for in-app purchase validation and management, analytics, crash and performance reporting, and advertising attribution or campaign-performance measurement. We do not receive or store the photos or videos you capture with the App on our servers.

10. Prohibited Uses

You agree not to:

1. reverse-engineer, decompile, disassemble, attempt to derive source code from, or create derivative works of the App except where such restriction is prohibited by law;
2. circumvent, disable, interfere with, or undermine any purchase, subscription, licensing, watermark, security, or access-control feature of the App;
3. use the App in violation of any law, regulation, court order, third-party right, or applicable Apple platform rule;
4. use the App for unlawful surveillance, stalking, harassment, fraud, impersonation, or any abusive, misleading, or harmful purpose;
5. use the App in a manner that could damage, disable, overburden, or impair the App or related services; or
6. remove, obscure, or alter proprietary notices, trademarks, or branding included in the App or in output where such notices are intentionally applied as part of the free-tier functionality.

11. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” TO THE FULLEST EXTENT PERMITTED BY LAW. WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, RELIABILITY, AVAILABILITY, SECURITY, OR THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE. WE DO NOT WARRANT THAT THE APP WILL MEET YOUR REQUIREMENTS, THAT CAPTURED MEDIA WILL ALWAYS BE SAVED SUCCESSFULLY, OR THAT ANY DEFECTS WILL BE CORRECTED. YOU ARE SOLELY RESPONSIBLE FOR BACKING UP YOUR DEVICE AND YOUR PHOTOS AND VIDEOS.

12. Limitation of Liability

To the fullest extent permitted by law, Ranjha Inc. and its officers, directors, employees, affiliates, contractors, licensors, and service providers will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, or for any loss of profits, revenue, business, goodwill, data, content, or device functionality, arising out of or related to your use of or inability to use the App, even if advised of the possibility of such damages.

To the fullest extent permitted by law, our aggregate liability for all claims arising out of or relating to the App or these Terms will not exceed the greater of (a) the amount you paid to us through the App for the App or related purchases during the 12 months before the event giving rise to the claim, or (b) $50 USD. Some jurisdictions do not allow certain limitations or exclusions of liability, so parts of this section may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless Ranjha Inc. and its officers, directors, employees, affiliates, contractors, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, and attorneys' fees arising out of or related to your content, your misuse of the App, your violation of these Terms, or your violation of any law or any third-party right.

14. Suspension and Termination

We may suspend or terminate your access to the App or any paid feature, without notice, if we reasonably believe you have violated these Terms, misused the App, or created risk, harm, or legal exposure for us or others. You may stop using the App at any time by uninstalling it. Sections that by their nature should survive termination will survive, including sections relating to intellectual property, disclaimers, limitations of liability, indemnification, governing law, and general terms.

15. Governing Law and Venue

These Terms are governed by applicable law, without regard to conflict-of-law principles. Except where prohibited by applicable law, any dispute arising out of or relating to these Terms or the App must be brought exclusively in a court of competent jurisdiction, and you consent to the personal jurisdiction and venue of that court.

16. Changes to These Terms

We may revise these Terms at any time by posting an updated version in the App, on this page, or both. The updated Terms become effective when posted unless a later effective date is stated. To the fullest extent permitted by law, your continued use of the App after updated Terms are posted constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App. Current Terms are available at flag7x.com/terms.

17. General Terms

If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision will not operate as a waiver. You may not assign or transfer these Terms without our prior written consent, and we may assign these Terms in connection with a merger, acquisition, corporate reorganization, or sale of assets. These Terms, together with any policies expressly incorporated by reference, constitute the entire agreement between you and us regarding the App.
